These Terms and Conditions outline the expectations, responsibilities, and policies that apply when you hire me, Jacqueline Lerma, for freelance graphic design services. By commissioning design work, you agree to the terms described below. These terms help ensure a smooth and professional working relationship that protects both you as the client and me as the designer.
When beginning a project, clients are expected to provide all necessary information, assets, and instructions in a timely manner. This may include brand guidelines, images, text, references, and any materials required to complete the design. Clear communication is essential, and I will maintain regular contact regarding drafts, updates, revisions, and deadlines. I reserve the right to refuse or pause a project if the required materials are not provided or if communication becomes inconsistent.
Payment terms will be discussed prior to starting any project. In most cases, a deposit may be required before work begins, with the remaining balance due upon completion of the project unless otherwise agreed. All invoices must be paid by the stated due date. Late payments may result in delayed deliverables or a pause in work. Digital and creative work will not be released in full resolution or with usage rights until full payment is received.
Revisions are part of the design process. Unless otherwise specified, each project includes a set number of revision rounds. Additional revisions beyond what is included in the original agreement may incur extra charges. Clients are encouraged to provide clear, consolidated feedback during each revision cycle to maintain efficiency and avoid unnecessary delays.
All design concepts, drafts, and preliminary work remain the intellectual property of the designer until the project is completed and paid for in full. After full payment, the client receives the rights to the final approved design for the agreed-upon usage. This may include commercial use, print, web, or branding applications. However, unused concepts, rejected drafts, and any working files (such as PSD, AI, or RAW formats) remain the property of the designer unless previously arranged.
I take great care in delivering high-quality, original work. However, the client is responsible for thoroughly reviewing all files, spelling, content, and final designs before production or publication. Once final files are approved and delivered, I cannot be held responsible for printing errors, misprints, or issues caused by third-party services.
All work created by me may be used for portfolio or promotional purposes only with the client’s written consent. If permission is granted, I may display the final approved design on my website, social media, or marketing materials. If the client requests confidentiality, I will honor that request and keep the work private.
Either party may end the project at any time. If a client chooses to cancel a project before completion, the client is responsible for payment covering all work already completed. Deposits are generally non-refundable unless otherwise stated. If I must cancel a project due to unforeseen circumstances, the client will receive a refund for any uncompleted work or undelivered portions of the project.
While I strive for accuracy and professionalism, I am not liable for business losses, legal issues, or damages resulting from the use of the final design. Clients are encouraged to seek legal or professional guidance when necessary, especially for trademarks, copyrights, or business registration related to their brand.
These Terms and Conditions may be updated periodically to reflect new policies, legal requirements, or workflow improvements. Clients will be notified if significant changes are made.
